Senate Bill 39: An act to Revise the Setoff Debt Collection Act

SUBJECT: Senate Bill 39: An Act To Revise The Setoff Debt Collection Act.

In order to comply with the revision of G.S. 105A (Setoff Debt Collection Act), this is to inform you of a change made in section 105A-3(d) Registration and Reports. This section states: A State agency must register with the Department of Revenue and with the State Controller. Every State agency must report annually to the State Controller the amount of debts owed to the agency for which the agency did not submit a claim for setoff and the reason for not submitting the claim. This bill was ratified in September 97 and section 105A-3(d) became effective immediately.

The revision includes the State Controller as an additional agency in which registration is required. Also, the first annual reporting period stated above will begin with the fiscal year end at 6-30-98.

It would be helpful to pull a copy of Senate Bill 39 and thoroughly review it to identify all changes that were made. For those who have internet access it is available on the General Assemblys website. We will be working with the Department of Revenue with regard to the clearinghouse concept explained in Section 3. There are various effective dates for the specific changes made within the bill that are listed in Section 4.
