Policy: Collection and Depositing of Processing Fees for Returned Checks Except Those Offered in Payment of Taxes

Authority:

  • G.S. 147-86.11(a) which requires the State Controller to develop, implement and amend as necessary a uniform statewide plan to carry out the cash management policy for all State Agencies.
  • G.S. 25-3-506 which regards collection of processing fee for returned checks.

Purpose: The purpose of this directive is to ensure that the State is reimbursed for costs associated with the collection of a returned check and that the appropriate fund is credited with the reimbursement.

Applicability: This directive shall apply to all checks received by the State except those received in payment of taxes.

Policy: State agencies, or their assignee, who accept a check in payment for goods or services will charge and collect a processing fee of twenty-five dollars for a check on which payment has been refused by the payor bank because of insufficient funds or because the drawer did not have an account at that bank. If a collection agency collects or seeks to collect on behalf of a State agency such processing fee, the processing fee must be separately stated on the collection notice.
